Information regarding personal data protection – The GDPR clause

 

Pursuant to Article 13 Section 1 and 2 of the Regulation (EU) 2016/679 of the European Parliament and of the Council dated 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (Official Journal of the European Union L. 2016.119.1), hereinafter referred to as GDPR, I inform you that:

1) The Controller of your personal data is MBL Poland Sp. z o.o.

2) Your personal data shall be processed for the purpose of exercising your rights and obligations arising from the employment relationship, pursuant to Article 6 Section 1 Clause c of the GDPR,

3) The recipient of your personal data shall be MBL Poland Sp. z o.o.

4) Your personal data shall be maintained for the duration of the employment relationship and for the mandatory period of retention of documentation related to the employment relationship and personal files, established in accordance with separate regulations,

5) You have the right to access the content of your data and the right to rectify, delete and restrict processing, as well as the right to data portability, the right to object, the right to withdraw consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent prior to its withdrawal,

6) You have the right to file a complaint with the data protection supervisory authority (currently: The Inspector General for the Protection of Personal Data) if you establish that the processing of personal data concerning you violates the provisions of the GDPR,

7) The provision of your personal data is a statutory requirement. Failure to do so shall result in the inability to fulfil the concluded employment agreement and the related tax and insurance obligations.

I am informed of my right to access and correct my data and to withdraw my consent to its processing at any time.

Pursuant to Article 13 of the Regulation (EU) 2016/679 of the European Parliament and of the Council dated 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”), we inform you that:

2) The legal basis for the data processing is Article 6 Section 1 Letter a of the GDPR i.e. the data subject has consented to the processing of their personal data for one or more specified purposes;

4) Your personal data shall be processed in order to carry out the recruitment process for the position for which you have applied.

6) Your personal data shall be maintained by the Controller for the duration of the recruitment process and no longer than 3 months from the date of receipt of your application.

7) Every data subject has the right to request access to their data, to rectify, delete or restrict processing, the right to data portability, the right to withdraw consent at any time without affecting the lawfulness of the processing carried out prior to the withdrawal of consent, as well as the right to object to processing and the right to file a complaint with a supervisory authority.

8) In relation to the processing of personal data, any data subject has the right to file a complaint with the supervisory authority.

 

Information clause for former employees

The Controller of your personal data processed in connection with the fact that you were an employee of MBL Poland Sp. z o.o. is MBL Poland Sp. z o.o. with its registered office in Piotrków Trybunalski, 97-300, ul. Sulejowska 45d, e-mail address: conatct@mbl.pl, hereinafter: the Controller.

Your data is processed in order to fulfil the Controller’s obligations as an employer to keep employment-related documentation, as well as to fulfil the Controller’s responsibilities as an advance payer of income tax and payer of Social Security (ZUS) contributions – Article 6 Section 1 Letter c of the Regulation (EU) 2016/679 of the European Parliament and of the Council dated 27/04/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Official Journal of the European Union L of 2016. No. 119, p. 1) – hereinafter referred to as GDPR, Article 9 Section 2 Letter b and h of the GDPR.

Should any claims arise, your data may also be processed for the purpose of defending/asserting these claims – as a legitimate interest pursued by the Controller (Article 6 Section 1 Letter f of the GDPR; Article 9 Section 2 Letter f of the GDPR)

The provision of your data was mandatory and resulted from labour, tax and social security legislation.

Personal data shall not be transferred to third countries or to an international organisation.

Within the scope of the law, you have the right to request access to your personal data, to rectify, delete or restrict processing, as well as the right to object to processing and the right to data portability.

Your data shall be maintained for the period required by law.

You have the right to file a complaint with the supervisory authority (President of the Personal Data Protection Office).
